In May 1995, the Applicant commenced proceedings against the Board regarding their treatment of his workplace injury compensation claim. The Actions was dismissed by Potts J. in 1995. Baksh commenced a second action against the Board in 1999 for the same claim, seeking $5 million and a declaration that various provisions of the Workplace Safety and Insurance Act. 1997, S.O. 1997, c. 16 were null and void on constitutional and other grounds. In addition, the Applicant asserted numerous other causes of action in, inter alia, misrepresentation, fraud, conspiracy and formulation of evidence.

The Applicant's second action was also dismissed. The Applicant's subsequent motions and appeals requesting extensions of time and the setting aside of previous orders were all dismissed. The Applicant seeks leave to appeal.
