Administrative law - Judicial review - Statutes - Interpretation - Definition of "co-employer" under ss. 12 and 13 of the Human Rights Code, R.S.B.C. 1996, c. 210 - Human Rights Tribunal concluded City was neither employer nor co-employer - Whether there was a line of analysis that could reasonably lead the Tribunal from the evidence to that conclusion.
The Applicants, civilians and mostly women, are dispatchers for the Vancouver Police Department. At one time, the police dispatchers were police officers, but they were replaced with civilians at a lower rate of pay. The current police dispatchers complain that they are paid about 40 per cent less dispatchers for the Vancouver Fire Department, who are firefighters and are mostly men. They filed a complaint against the Respondents the City of Vancouver and the Vancouver Police Board under the Human Rights Code, R.S.B.C. 1996, c. 210, ss. 12 and 13.
The British Columbia Human Rights Tribunal was asked to determine which Respondent employed the police dispatchers, or whether they were co-employers. It found that the police dispatchers were employed by the Board, but not by the City. An application for judicial review was allowed, as was an appeal.
