The procedure, under Division 9 of Part 1 of the Immigration and Refugee Protection Act, S.C. 2001, c. 27, is inconsistent with the Canadian Charter of Rights and Freedoms, and hence of no force or effect. This declaration is suspended for one year from the date of this judgment. However, as of the date of this judgment, s. 84(2) is struck, foreign nationals are read into s. 83, and the words "until a determination is made under subsection 80(1)" are struck from s. 83(2).

Canadian Charter of Rights and Freedoms - Civil rights - Immigration law - Procedure - Evidence - Security certificate - Inadmissibility - Statutes - Interpretation - Whether the Federal Court erred in concluding that the provisions of sections 76 to 80 of the Immigration and Refugee Protection Act S.C. 2001, c. 27, comply with the fundamental justice provisions of Section 7 of the Charter - If so, is the infringement a reasonable limit under section 1?

The Solicitor General of Canada and the Minister of Citizenship and Immigration issued a security certificate in respect of Mohamed Harkat that sets out their belief that he is inadmissible to Canada on security grounds pursuant to paragraphs 34(1)(c) and 34(1)(f) of the Immigration and Refugee Protection Act, S.C. 2001, c. 27 (“IRPA”). A person is inadmissible when there are reasonable grounds to believe that he or she has engaged in, or will engage in, terrorism; and was, or is, a member of a terrorist organization. The allegations against Harkat, an Algerian native, is that he has supported terrorist activity and is a member of the Bin Laden Network. As required by ss 77(1) of the IRPA the certificate was referred to the Federal Court for a determination as to whether it is reasonable. The certificate was upheld as reasonable.

In the course of the proceedings, Harkat challenged the constitutionality of the statutory scheme in ss. 77 to 81 of the IRPA. The motion for constitutional relief was dismissed. Harkat’s appeal to the Federal Court of Appeal on the constitutional issue was dismissed..
