Wilder was convicted of seven counts of fraud and one count of possessing the proceeds derived from those frauds. He was sentenced to nine years in jail and a ordered to pay a restitution order of $5 million. The frauds arose within a sophisticated scheme carried out in 1984 and 1985 utilizing the Scientific Research and Tax Credit program under the Income Tax Act. As president of two companies, Wilder signed certificates falsely warranting that the companies had incurred expenses on research and development far in excess of their actual expenditures, leading to the fraudulent creation of tax credits for which cash of $38 million was paid to the companies, defrauding the Canadian government.

After a trial lasting almost three years, Wilder was acquitted. The Court of Appeal allowed the Crown’s appeal and ordered a new trial. Leave to this Court was denied. The re-trial lasted two years. Wilder was subsequently convicted and his appeal on the conviction was dismissed. Leave to this Court was denied, as was a motion for reconsideration of the dismissal of the application for leave to appeal. Wilder now appeals his sentence and restitution order which was also denied by the Court of Appeal.
