Canadian Charter - Criminal law - Extradition - Whether Court of Appeal erred in law in interpreting s. 32(2) of Extradition Act, and more specifically as regards concept of "evidence gathered in Canada" - Whether Court of Appeal erred in law in interpreting s. 44(1) of Extradition Act by concluding that provision did not give Minister of Justice authority to review decision of extradition judge regarding existence of prima facie case - Whether ss. 32 and 33 of Extradition Act constitutional.

The Applicant is sought by the requesting state to stand trial for murder. It is alleged that the Applicant killed the only witness who could have testified against him in a drug trafficking case. An associate of the Applicant subsequently made declarations identifying the Applicant as the murderer.
