Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
Procedural law - Judgments and orders - Judicial Immunity - Collateral attack - Abuse of process - Frivolous and vexatious litigation - Section 82 of the Courts of Justice Act (Ontario).
The Applicant brought an action against two Deputy Small Claims Court Judges with respect to decisions they made in the Applicant's small claims court action against a neighbour. He also brought claims against the lawyer representing the neighbour in those and other proceedings. The Applicant alleges various scams and dirty schemes by the Respondents to rig and manipulate the judicial system. The Respondents brought a motion to strike the Statement of Claim and dismiss the action against them on the grounds that the claim disclosed no cause of action, and was frivolous, vexatious and an abuse of process.
