Crown law – Relative immunity of Crown attorneys – Whether courts below erred in finding that Crown attorney had reasonable and probable grounds to commence legal proceedings against Applicant and that Crown attorney showed no malicious intent against him – Whether courts below erred in finding that scope of Crown attorney's duty to disclose was ambiguous prior to R v. Stinchcombe, [1991] 3 S.C.R. 326.

In December 1994, after a second trial, Mr. Filion was acquitted of a charge of first degree murder. He subsequently brought an action against the Attorney General of Quebec, claiming $5,580,000 in damages for acts committed by the Crown attorney. His main allegation was (1) that before the first trial, the Crown attorney deliberately failed to disclose to him information that was essential to the preparation of his defence. He added (2) that the Crown attorney had no reasonable and probable grounds to lay the charges and, in doing so, (3) was motivated by a malicious intention, namely to have Mr. Filion convicted at all costs. The Superior Court dismissed Mr. Filion's claims. The Court of Appeal affirmed the judgment.
