When the St. Anne-Nackawic Pulp Company Ltd. made a voluntary assignment in bankruptcy, its two benefit pension plans registered under the Pension Benefits Act, S.N.B. 1987, c. P-5.1, were underfunded. Under the distribution of benefits that would have been effected under the regulatory distribution scheme then in effect, only members 55 years of age and over would have shared in the insufficient proceeds, while those under 55 years old would have received only their minimal personal contributions. The Respondent Government of New Brunswick amended the Act and adopted new regulations retroactively changing the priority scheme. Under Regulation 2005-157, the distribution of pension proceeds was improved for those under 55 years of age, at the expense of those plan members 55 years of age and over. The Applicants sued the Respondent Province, and plan members under 55 years of age were added as parties.
