Extradition - Committal hearing - Where a foreign police force avails itself of the services of a civilian in Canada, what is the test to determine whether that foreign police force is investigating in Canada in contravention of Canadian sovereignty? - Whether foreign states are permitted to aid and abet the commission of criminal offences in Canada.
The Government of the United States of America (the “Requesting State”) has requested the extradition of Cheema, Lorenz and Narayan from Canada to the United States for prosecution on a number of drug charges. Cheema, Lorenz and Narayan are charged in the United States with conspiracy to distribute heroin, conspiracy to possess heroin with the intent to distribute it, conspiracy to possess cocaine with the intent to distribute it, attempted possession of heroin with the intent to distribute it, possession of heroin with the intent to distribute it and aiding and abetting. The Extradition Judge committed Cheema for extradition, but found there was insufficient evidence to commit Narayan and Lorenz and issued discharges in their cases. The Court of Appeal dismissed Cheema’s appeals from the orders of committal and surrender, allowed the appeal of the Attorney General with respect to Narayan and ordered his committal pursuant to the Extradition Act, but dismissed the appeal of the Attorney General in respect of the discharge of Lorenz.
