2008-11-25 Decision on the motion to file a reply factum on appeal, Ro, UPON MOTION by the respondent for an order:
1) to file a reply factum of no more than fifteen pages, restricted only to issues raised in the interveners' factum that were filed after the respondent’s factum was filed;
2) to file a respondents’ record consisting of only the September 7, 1999 submissions of the Ministry to the Information and Privacy Commissioner, which appears as Tab 29 of the Public Record before the Divisional Court; and
3) to make oral submissions for one hour and fifteen minutes at the hearing of the appeal.
AND THE MATERIAL FILED having been read;
IT IS HEREBY ORDERED THAT:
1) The motion is granted in part;
2) The request to file a reply factum is granted. The reply factum shall not exceed 5 pages and shall be limited to submissions on solicitor-client privilege and on the case of Canada (Privacy Commissioner) v. Blood Tribe Department of Health, 2008 SCC 44. The reply factum shall be served and filed on or before December 1, 2008;
3) The request to file a respondents’ record consisting of only the September 7, 1999 submissions of the Ministry to the Information and Privacy Commissioner, which appears as Tab 29 of the Public Record before the Divisional Court is granted;

2008-11-25 Decision on miscellaneous motion, Ro, UPON MOTION by the appellants for an order:
1) that the intervener Tom Mitchinson, Assistant Commissioner, Office of the Information and Privacy Commissioner of Ontario does not have standing to make detailed and elaborate arguments on the merits of the constitutional issues;
2) expunging the Office of the Information and Privacy Commissioner of Ontario’s factum;
3) directing the Office of the Information and Privacy Commissioner of Ontario to limit its oral submissions to explaining the record and issues of jurisdiction;
4) expunging certain paragraphs of the factum of the intervener, the Information Commissioner of Canada – namely the first two sentences of paragraph 2, paragraph 3 (except for first sentence), paragraph 5b, paragraphs 12-16 and paragraphs 21 as well as the term “Charter values” where it appears in paragraph 5C, 17, 18 and 20;
5) granting the appellants leave to file a 7 page reply factum.
AND THE MATERIAL FILED having been read;
IT IS HEREBY ORDERED THAT:

2) The request to file a 7 page reply factum is granted. F.31 (the “Act”) - Whether s. 23 of the Act infringes s. 2(b) of the Canadian Charter of Rights and Freedoms and/or an underlying principle of constitutional democracy by failing to extend the public interest override to the law enforcement and solicitor-client exemptions - Justification under s. 1 of the Charter - Does s. 2(b) of the Charter include a right to compel government to disclose information? - Does the claimant who impugns a statutory exemption from a statutory right, seek a positive entitlement to government action or a right to be free from government interference? - Does the Charter require that government documents protected by solicitor-client privilege be subject to a balancing test on a case-by-case basis to determine if they will be disclosed?

Severe judicial criticism of the conduct of the Crown in its prosecutorial role and of the police in their investigative role, led to a stay of proceedings in the retrial of two men charged with the murder of Dominic Racco: R. v. Court and Monaghan (1997), 36 O.R. (3d) 263. The Ontario Provincial Police was asked to review the conduct of the police officers and Crown counsel and found no evidence of any attempts to obstruct justice. The Respondent submitted a request to the Appellant Ministry under the Ontario Freedom of Information and Protection of Privacy Act, R.S.O. 1990, c. F.31, seeking access to the records underlying the OPP’s investigation. The Appellant declined to produce certain records on the basis of the exemptions in ss. 14 (law enforcement records), 19 (solicitor-client privilege) and 21 (personal privacy) of the Act. The Respondent appealed the decision before the Office of Information and Privacy Commissioner, who upheld the Appellant’s decision. The Respondent applied for judicial review of the Commissioner’s decision. The application for judicial review was dismissed. On appeal, the Court of Appeal allowed the appeal and the matter was remitted to Office of Information and Privacy Commissioner for re-determination with ss. 14 and 19 read into s. 23 of the Act.
