(Publication ban in case) (publication ban on parties)

Civil procedure – Contempt of court – Superior Court ordering taking of sample of bodily substance – Failure to comply with order – Whether contempt of court conviction justified.

In March 2002, [G.G] initiated an action to claim status in order to have [G.S.] recognized as the father of her child. In the course of that action, the court ordered that a sample of a bodily substance be taken for the purpose of establishing the genetic profile of [G.S.]. [G.S.] failed to comply with the order and was convicted of contempt of court.
