Family law – Custody – Child made a ward of the Crown – Applicant found to be a “special party” under Rule 2(1) of the Family Law Rules – Public Guardian and Trustee appointed to represent mother in legal proceedings – Appeal of this appointment dismissed – Whether the lowers courts erred in their reasons and decision.

On August 14, 2008, an order was made making the applicant’s child a ward of the Crown and placed in the care and custody of the Society, with access to the applicant at the Society’s discretion. On September 12, 2008, the applicant served a Notice of Appeal of the Crown wardship order. On March 17, 2009, on motion from the Society, the applicant was found to be a “special party” and the Office of the Public Guardian and Trustee were appointed to represent the applicant in the proceedings. On January 7, 2010, the applicant’s appeal of the March 17, 2009 finding that the applicant was a “special party” and the appointment of the Public Guardian was heard in the Court of Appeal. The Court of Appeal dismissed the appeal.
