Torts – Negligence – Causation – Sufficiency of evidence - Would it be in the public interest for this Court to set out principles for the application of the “but for test” and “material contribution test” to guide lower and provincial appellate courts in the proper application of these commonly used but often misapplied tests - Did the Court of Appeal err in law by making reference to Athey v. Leonati, [1996] 3 S.C.R. 458 and importing an element of the material contribution test, thereby failing to apply the “but for” test in a manner consistent with this Court’s approach in Resurfice Corp. v. Hanke, 2007 SCC 7, [2007] 1 S.C.R. 333.

The Respondent Mrs. Cartner slipped and fell on a sidewalk as she walked to work. It was found that she had slipped on a muddy concrete slurry substance that had pooled on the sidewalk just south of the Crystal Shoes Store property owned by Feng Feng Wang and Ying Jia Huang (the “Property Owners”). Mrs. Cartner and her husband commenced an action in damages against the Property Owners and the applicant City. She alleged, inter alia, that the Property Owners were liable in nuisance and/or negligence for washing concrete residue off their property with a hose, and that the City was liable for failing to meet its statutory duty to keep the sidewalk in a reasonable state of repair. The City denied there was any evidence of non-repair.
