Criminal Law – Offence – Defences – Sexual assault – Honest but mistaken belief in consent – Whether Court of Appeal has improperly restricted the defence of honest but mistaken belief in consent and thus impermissibly expanded the definition of sexual assault.
The applicant, part owner of a restaurant-bar, was convicted of a sexual assault committed against SP, a employee working as a bartender. SP testified that while she was standing behind the bar, the applicant came up behind her and that he put his arm around her waist for three to four seconds while he uttered a statement of sexual desire. The applicant admitted this conduct. The restaurant and bar encouraged a “party atmosphere” and encouraged staff to dress and behave provocatively. The trial judge described testimony from the applicant that SP and another female employee previously had sandwiched him while SP squeezed his butt as a “red herring” and he rejected the applicant’s testimony that he and SP previously had exchanged a romantic kiss at the back of the restaurant. He rejected a claim of honest but mistaken belief in consent.
