Criminal Law – Evidence – Hearsay – Whether evidentiary rule that a statement against penal interest is only admissible if traditional hearsay exception prerequisites are met should be abrogated – Whether prior confession by a witness to the crime with which the accused is charged should always be admissible for the truth of its contents even if the witness denies its truth at trial – Principles applicable to a witness’ pre-trial confession, even though repudiated at trial, if the substance of the confession and its subsequent repudiations are linked circumstantially in a way that suggests the witness is manipulating the truth in order to evade the consequences of his confession.
The applicant was convicted by a jury of the first degree murder of his ex-girlfriend and of manslaughter in relation to the death of her sister. The applicant’s cousin, Adrian Kinkead, was convicted in separate proceedings of first degree murder and manslaughter. Kinkead testified at the applicant’s trial that the applicant committed the murders. However, when arrested, Kinkead had confessed to the murders and told the police that the applicant was not involved. Between his arrest and the applicant’s trial, Kinkead gave different and conflicting accounts of the murders.
