The applicant, Canadian Society of Immigration Consultants (the “Society”), acted as the sole regulatory body of immigration consultants in Canada from April 2004 to June 2011. In June 2011, its status as regulator was revoked and the Immigration Consultants of Canada Regulatory Council was put in its place by regulations made by the Governor in Council and the Minister of Citizenship and Immigration. The Society filed an application for judicial review arguing, among other things, that the process leading up to the enactment of the regulations was procedurally unfair. The Federal Court dismissed the application for judicial review. The Federal Court of Appeal dismissed the appeal.
