Mr. Malik was employed by the Respondents as a taxicab driver, but was laid off in September, 2007 after the Respondents received complaints about him that he had propositioned a female passenger. Mr. Malik brought an action against the Respondents in November, 2007, claiming damages for defamation. He alleged that the Respondents published false statements about him that he had committed a sexual assault on September 13, 2007, thereby causing him to lose his job and damaging his reputation. Mr. Malik was charged with assault in December, 2007. He spent approximately two years defending the charge and was eventually acquitted. During that time, he did not proceed with his civil action. Pleadings closed in March, 2008. A status notice was sent to him and he requested a hearing. The Respondents requested that he show cause why the action should be permitted to proceed.
