2014-02-17 Judgment on the appeal rendered, LeB Cro Mo Ka Wa, The appeal from the judgment of the Court of Appeal of Alberta (Calgary), Number 1201-0047-A, 2013 ABCA 219, dated June 14, 2013, was heard on February 17, 2014, and the Court on that day delivered the following judgment orally:

MOLDAVER J. — We agree with the conclusion of the Court of Appeal. In particular, taking the record at its highest for the appellant, there was no evidence that the appellant took any reasonable steps to ascertain whether the complainant was consenting to sexual relations following her initial rejection of the appellant’s sexual advances. With respect, the trial judge erred in law in finding that there was some evidence that he had taken reasonable steps as required by s. 273.2(b) of the Criminal Code.

Accordingly, the appeal is dismissed.

Dismissed, no order as to costs

Mr. Flaviano was acquitted of one count of sexual assault. He was the owner of a rental unit occupied by the teenage complainant, her mother and step-father. It is alleged that Mr. Flaviano assaulted the complainant while at the unit fixing the dishwasher. The complainant and Mr. Flaviano testified at trial, but their testimony differed dramatically. Mr. Flaviano’s position was that the complainant had consented, and his fallback position was that if the complainant had not consented, then he was mistaken about that. The trial judge acquitted him on that basis. On appeal, the Crown argued that there was no air of reality to the defence of mistaken belief in consent. The Court of Appeal agreed and entered a conviction.
