Administrative law — Boards and tribunals — Appeal of review decision by Criminal Injuries Review Board — Whether Court of Appeal committed a reviewable error.
In September 2007, Mr. Twerd was the victim of an assault by unknown assailants. Shortly after the assault, he indicated to police that he did not wish further police involvement in the matter. His injuries required medical attention.
Mr. Twerd applied for benefits from the Victims of Crime Financial Benefits Program. By letter dated December 16, 2009, his application was denied by an Eligibility Adjudicator based on s. 13(3)(b) of the Victims of Crime Act, R.S.A. 2000, c. V-3. Section 13(3)(b) empowers the Director to deny benefits where the application “did not fully co-operate with any investigation into the events that resulted in the injury or death of the victim”.
Mr. Twerd filed a Notice of Request for Review with the Criminal Injuries Review Board. He made an oral presentation to the panel and answered the panel’s questions. The panel also had access to the Director’s file, including the police reports. The Criminal Injuries Review Board confirmed the Director’s decision. Mr. Twerd’s further appeal to the Court of Appeal was dismissed.
