Law of professions – Lawyers – Discipline – Provisional disbarment – Whether disciplinary council of Barreau du Québec erred in imposing immediate provisional disbarment on applicant.

In 2012, the respondent, the assistant syndic of the Barreau du Québec, filed a complaint against the applicant, Mr. Choquette, alleging that he had violated ss. 2.00.01, 2.01.01 and 3.02.01(c) of the Code of ethics of advocates, C.Q.L.R. c. B 1, r. 3, and ss. 59.2, 114 and 122 of the Professional Code, C.Q.L.R. c. C 26. The complaint arose out of legal proceedings in which Mr. Choquette was involved as a lawyer. The complaint filed by the assistant syndic was accompanied by a request for immediate provisional disbarment. Finding that the complaint raised grave and serious allegations undermining the purpose of the profession, that the protection of the public could be compromised and that there was prima facie evidence that Mr. Choquette had committed the alleged acts, the disciplinary council of the Barreau du Québec granted the request. The Professions Tribunal confirmed that decision.
