Charter of Rights and Freedoms – Criminal law – Whether the trial judge erred in law and erred in her findings of credibility – Whether the applicant’s Charter rights were violated during the trial – Whether the summary conviction appeal judge erred by allowing the appeal in part – Charter, ss. 2, 10(g), 12, 15(1), 24(2), 27, 28.

The applicant was convicted of sexual assault, was found not criminally responsible and was detained for two and one-half months. A Queen’s Bench judge, sitting as a summary conviction appeal court, allowed the applicant’s appeal in part, substituting a conviction for common assault and a sentence of time served. The Court of Appeal dismissed the applicant’s application for leave to appeal.
