Civil procedure – Appeals – Applicant seeking to appeal dismissal of action for damages for loss of interest in property – Applicant applying for extension of time to file notice of appeal – Whether respondent liable for damages for fraud.
The applicant brought an action against the respondent for fraud with respect to monies the respondent allegedly provided to the applicant for the purchase of a home in 1984, in exchange for an interest in the home. The applicant’s claims were dismissed at trial. Several months later, he applied for an extension of time in which to appeal the trial judge’s decision.
