Constitutional law – Division of powers – Protective re-assignment of pregnant employee under Canada Labour Code – Application of income replacement indemnity under Act respecting occupational health and safety to federal undertaking – Whether statutory amendments to Canada Labour Code since 1993 and Supreme Court judgments in Canadian Western Bank v. Alberta, [2007] 2 S.C.R. 3, Tessier Ltée v. Quebec (Commission de la santé et de la sécurité du travail), [2012] 2 S.C.R. 3, Quebec (Attorney General) v. Canadian Owners and Pilots Association, [2010] 2 S.C.R. 536, Marine Services International Ltd. v. Ryan, [2013] 3 S.C.R. 53, and Martin v. Alberta (Workers’ Compensation Board), [2014] 1 S.C.R. 546, justify challenging principle that section 36 of Act respecting occupational health and safety does not apply to federal undertaking – Canada Labour Code, R.S.C. 1985, c. L-2, ss. 131, 132, 204, 205, 205.1, 205.2 – Act respecting occupational health and safety, CQLR, c. S-2.1, ss. 36, 40, 41, 42.
The applicant, Marie-Ève Éthier, is a team leader for a federal undertaking, the respondent Canadian National Railway Company, at the Charny train station. As a result of a report from her physician, Ms. Éthier, then seven weeks pregnant, asked the respondent to modify her job functions or, if this was not possible, to grant her the leave of absence provided in the Canada Labour Code for employees who are pregnant or nursing. The respondent informed her that it was unable to reassign her. Consequently, Ms. Éthier chose to go on leave. The Canada Labour Code is silent, however, on whether employees receive pay for the duration of this leave. Ms. Éthier therefore turned to the Commission des normes, de l’équité, de la santé et de la sécurité du travail (formerly the Commission de la santé et de la sécurité du travail) in order to obtain the income replacement indemnity provided under the Act respecting occupational health and safety. The Commission informed her that she was not entitled to this indemnity since her employer is a federal undertaking.
