Criminal law – Appeal – Appeal to Supreme Court of Canada – Whether Court of Appeal erred in refusing leave to appeal – Whether application for leave to appeal raises question of public importance – Whether motion judge erred in applying criteria of s. 55.9.11 of Animal Health Protection Act, R.S.Q., c. P-42.

On July 29, 2015, the applicants’ animals were seized by the Ministère de l’Agriculture, des Pêcheries et de l’Alimentation and placed in an emergency shelter, where they were kept and cared for at great expense. The Court of Québec refused to return the animals to the applicants and granted a motion to dispose of the seized animals. The applicants contested the validity of that decision. The Superior Court affirmed the motion judge’s decision. The Court of Appeal denied leave to appeal.
