The applicant, Ms. Bouchard, applied to the Superior Court for authorization to institute a class action on behalf of all persons who had been affected — as she had — by one or more errors in the Phoenix system while they were employed by the Government of Canada.

The Superior Court authorized the class action, but it was of the view that the class covered by the action should be defined by excluding persons subject to the grievance process under ss. 206 et seq. of the Federal Public Sector Labour Relations Act. The Court of Appeal unanimously dismissed the appeal filed by Ms. Bouchard to try to broaden the class, among other things. It agreed with the application judge’s reasons.
