Mr. Doyle was charged with committing the offence of constructing an accessory building without a principal building, structure or use having first been completed contrary to ss. 6.3.7 and 4.3.1 of the Comprehensive Zoning By law of the Municipality of the Northern Bruce Peninsula. He was also charged with constructing a building without a building permit contrary to s. 8(1) of the Building Code Act, 1992, S.O. 1992, c. 23. He was convicted on both counts at trial. On appeal, the conviction entered on the second count was set aside and an acquittal entered. On further appeal, the convictions and sentences imposed on both counts were reinstated.
