The applicant pled guilty to two counts of fraud over $5,000.00. The applicant was sentenced to 5 ½ years’ imprisonment. The Court of Appeal granted leave to appeal the sentence, and dismissed that appeal. The Court of Appeal held that mental illness was not a factor to be taken into consideration when determining a fit sentence.
