The applicant sought a licence for the purpose of building a private micro-scale run-of-river hydroelectric project. The river on which he proposed to build the generator was located on the traditional territory of the Cheam First Nation and was of significant spiritual importance to the Cheam First Nation. The respondent denied the applicant’s application. The applicant’s application for judicial review was dismissed. The Court of Appeal dismissed the applicant’s appeal.
