Mr. Laho was a member of Unifor Local 414 when he was employed by New Dominion Stores, a division of Metro Ontario Inc. He filed a complaint to the Ontario Labour Relations Board alleging Unifor breached its duty of fair representation by not properly assisting him in disputes with his employer and with claims to Ontario’s Workplace Safety and Insurance Board. The Ontario Labour Relations Board terminated the application and denied reconsideration. The Divisional Court of the Ontario Superior Court of Justice dismissed an application for judicial review. The Court of Appeal denied leave to appeal.
