In March 2019, a cyber incident occurred whereby a former employee of the applicant Amazon group gained unauthorized and unlawful entry to the applicant Capital One group’s credit card application processing system and accessed certain types of personal information relating to people who had applied for or were customers of certain Capital One credit card products. The respondent, M. Royer, applied to institute a class proceeding before Quebec courts, alleging damage suffered as a result of the incident. The Superior Court granted M. Royer’s authorization application, and the Court of Appeal allowed his appeal seeking to broaden the scope of compensable loss claimed to include moral damages. At the same time, the Court of Appeal dismissed the Capital One group and Amazon group’s incidental appeals which sought to dismiss M. Royer’s authorization application on the basis of deficiencies in his pleadings.
Lower court rulings
Application by M. Royer for authorization to institute a class action and to serve as class representative granted;
Class of members described as “all persons, entities, or organizations residing in Quebec who had a credit card issued by Capital One or applied to obtain one and whose personal information was subject to unauthorized access on March 22 and 23, 2019”;

d) Are the Capital One group defendants and the Amazon group defendants liable to pay the Class members the costs of monitoring their Capital One credit card accounts and statements for a period greater than two years, and if so, what costs may be claimed?
e) Did the Capital One group defendants interfere with the Class members’ right to privacy under the Charter of human rights and freedoms?
f) Are the Capital One group defendants liable for punitive damages to the Class members, and if so, in what amount?
