The applicant, a lawyer who was on the Roll of the Order of Advocates at the time, represented an individual in litigation against Investissement Québec before the Superior Court, the Court of Appeal and the Supreme Court of Canada. In that litigation, the Court of Appeal granted a motion to dismiss the appeal, noting that the allegations of bias made against the Superior Court judge who had heard the case at first instance were [TRANSLATION] “unsupported”. A disciplinary complaint containing two counts was filed against the applicant because of things she had said and comments in writing she had sent in the context of that litigation. The disciplinary council of the Barreau du Québec convicted the applicant of breaching some of her ethical obligations and imposed penalties on her, and those conclusions were upheld on appeal by the Professions Tribunal. The Superior Court subsequently dismissed the applicant’s application for judicial review after an application to dismiss was filed by the respondent the assistant syndic of the Barreau du Québec. The Court of Appeal refused leave to appeal from that judgment.
