Following a trial by judge alone in the Superior Court, the applicant, Septimus Neverson, was found guilty of 54 counts related to 13 break ins at dwelling houses. When combined with the similar fact evidence, which was ruled admissible in evidence, the circumstantial evidence and the confessions to two witnesses led the trial judge to find Mr. Neverson guilty beyond a reasonable doubt. The Court of Appeal dismissed the appeal, holding, among other things, that the similar fact evidence represented an accumulation of facts significant enough to demonstrate the improbability of coincidence.
