In the context of a history of litigation involving the parties, the Superior Court summarily dismissed Mr. Lapierre’s originating application on the ground that some of his claims were barred because of a clear absence of legal interest and others were clearly unfounded, including because they were prescribed. The judge also found that the originating application was abusive.

The Court of Appeal dismissed Mr. Lapierre’s application for leave to appeal. The court held that the application for leave to appeal and the notice of appeal did no more than briefly state a few grounds, without precisely identifying the errors allegedly made by the trial judge. The court was of the view that the proposed appeal raised no question of principle, new issue or issue that had given rise to conflicting judicial decisions.
