In the context of the theft of personal data of several millions of members of the Desjardins Group in 2019, the respondent, Sureté du Québec, brought a motion before the Superior Court for a determination as to the existence and scope of a public interest privilege, namely informer privilege, with respect to the content of certain information obtained in the course of an investigation and for the issuance of protection and sealing orders. On May 14, 2024, the Superior Court granted the motion and issued the required orders, including that of reserving the rights of potential accused to rely on the innocence at stake exception. The applicant, Mr. Joncas, further to receiving a copy of that judgment on June 7, 2024, filed an application for leave to appeal to the Supreme Court accompanied by a motion for an extension of time for its service and filing.
