IT IS HEREBY ORDERED THAT:

The motion for an extension of time filed by the Trial Lawyers Association of British Columbia and by Harry Arthur Cope are granted.

The motion filed by Women’s Legal Education & Action Fund for an order that the Affidavit of Kat Owens, filed in support of the Motion for Leave to Intervene, be included in the record for the hearing of the appeal is dismissed.

The motion for leave to intervene filed by Association québécoise des avocats et avocates de la défense is granted. In this appeal there is no constitutional challenge to the relevant legislation. The intervener shall not raise the argument that ss. 718.04 and 718.201 of the Criminal Code is discriminatory towards Indigenous offenders under s. 15 of the Charter. This s. 15 Charter argument is a new issue which was not raised in the courts below.

The Indigenous respondent pleaded guilty to the aggravated assault of his Indigenous common law partner. He had a significant criminal record and a history of serious mental illness. The sentencing judge concluded the respondent’s incarceration was required to protect the public. The respondent was sentenced to five years in prison for the aggravated assault and eight months’ incarceration for breaches of release orders. A majority of the Court of Appeal granted leave to appeal the sentence, allowed the appeal, and varied the sentence to three years’ imprisonment for aggravated assault. The dissenting justice would have granted leave to appeal and dismissed the appeal.
