The applicant is the tenant of a residential unit. In early 2023, she complained to her landlord that her fridge was not in working order and that excessive fan noise was coming from a neighbouring unit. The landlord arranged an inspection of both issues. The fridge was in working order and the fan did not appear to be generating excessive noise. The landlord nevertheless replaced the fan, and, after the hearing of this matter at the Court of Appeal, replaced the fridge.

The applicant applied to the Residential Tenancies Branch for a retroactive rent abatement and orders to remedy both alleged issues.

The RTB arbitrator dismissed the application, finding no evidence that the landlord was aware of the issues before the applicant complained, and that the evidence did not support orders to repair.

The applicant sought judicial review. The chambers judge dismissed that application, holding that the hearing was procedurally fair, that none of the arbitrator’s findings were patently unreasonable, and that there was no evidentiary basis to find that the arbitrator was biased against the applicant. The Court of Appeal dismissed an appeal for substantially the same reasons.
