Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
A lawyer’s former client contested the lawyer’s accounts for fees and disbursements. The parties did not come to an agreement with a conciliator’s help, and the former client then applied for arbitration. The arbitration council refused to reduce the lawyer’s accounts. The Court of Québec homologated the arbitration council’s decision and dismissed the former client’s application to set it aside. The court also declared that the former client’s proceedings were abusive. The Court of Appeal dismissed the former client’s application for leave to appeal, holding that it had no chance of success.
Lower court rulings
Application to set aside dismissed, arbitration award homologated and Mr. Mansuy’s proceedings declared abusive
