The Superior Court of Quebec granted the application of the respondent Review Committee of the Quebec Bar (“Review Committee”) to dismiss an application for judicial review filed by the applicant, Mr. Rankin. It then dismissed the applicant’s application for judicial review.
The Quebec Court of Appeal granted the Review Committee’s motion to dismiss the applicant’s appeal and dismissed the appeal. It held that because the applicant had not sought leave to appeal, the application to dismiss could be granted for this reason alone. The court added that even if leave to appeal had been properly sought, it would not have been granted as the criteria set out in art. 30 para. 3 of the Code of Civil Procedure, CQLR, c. C-25.01, were not met, principally because the appeal had no reasonable chance of success.
