In 2017, Mr. Reilly and MS were arrested and each was held without bail for more than 24 hours. Section 503 of the Criminal Code, R.S.C. 1985, c. C-46, mandates an accused shall be brought to court for a bail hearing within 24 hours if a justice is available or as soon as possible if a justice is not available. Mr. Reilly and MS commenced a claim against the Province of Alberta alleging negligence and breaches of Charter rights. The Court of King’s Bench of Alberta certified the action as a class proceeding. A majority of the Court of Appeal dismissed an appeal.
