The motion for an extension of time is granted.

The motion for leave to intervene by Wabun Tribal Council and Kátl’odeeche First Nation is granted and the joint interveners are entitled to serve and file a single factum, common to both appeals, not to exceed ten (10) pages in length, and book of authorities, if any, on or before November 10, 2025.

The joint interveners are granted permission to present oral argument covering both appeals, not exceeding five (5) minutes, at the hearing of the appeals.

The motions for leave to intervene in the appeal Nisga’a Nation, as represented by the Nisga’a Lisims Government v. Malii also known as Glen Williams, et al. (41516) are granted and the eleven (11) interveners or groups of interveners shall each be entitled to serve and file a single factum, not to exceed ten (10) pages in length, and book of authorities, if any, on or before November 10, 2025.

The motions for leave to intervene in the appeal Skii km Lax Ha, also known as Darlene Simpson, also known as Chief Simpson, on behalf of herself and in her capacity as Tsetsaut/Skii km Lax Ha Hereditary Chief, et al. v. Malii also known as Glen Williams, et al. (41644) are granted and the ten (10) interveners or groups of interveners shall each be entitled to serve and file a single factum, not to exceed ten (10) pages in length, and book of authorities, if any, on or before November 10, 2025.

For greater certainty, the eight (8) interveners or groups of interveners granted leave to intervene in both appeals may serve and file only one (1) single factum common to both appeals, not to exceed ten (10) pages in length.

The interveners or groups of interveners are each granted permission to present oral argument not exceeding five (5) minutes, at the hearing of the appeals.

The respondent Gitanyow Nation asserts Aboriginal rights and title over certain lands in British Columbia, and has advanced claims against the federal and provincial Crown. Another Aboriginal group with a modern treaty covering an overlapping geographic area, the appellant, the Nisga’a Nation, sought to be added as a defendant in the Gitanyow action.

A case management judge at the Supreme Court of British Columbia dismissed the Nisga’a Nation’s application to be added as a defendant. A unanimous panel of the Court of Appeal dismissed the Nisga’a Nation’s appeal from the first decision.
