The applicant is a physician, and is currently the subject of professional discipline proceedings. The respondent was counsel to the administrative body that initiated those proceedings. When the applicant sued the respondent in connection with his involvement as counsel in these proceedings, the respondent applied to strike his claim. While the decision on this application was on reserve, the applicant sought the recusal of the application judge.

After disclosing relevant facts to the parties, the application judge concluded that the applicant’s recusal application was not timely, and in any event there was no evidence supporting actual bias or a reasonable apprehension of bias. He further determined that recusal out of an abundance of caution was inappropriate.

The applicant is a vexatious litigant and required leave to appeal the application judge’s decision. The Court of Appeal denied leave, finding that the proposed appeal was destined to fail, concerned only questions of settled law, and did not raise any issue of greater importance.
