The applicant filed a complaint with the Alberta Human Rights Commission against the respondent, Citi Financial Canada Inc. The complaint was dismissed. The Director of the Alberta Human Rights Commission initiated an application for judicial review but it was not filed within the time period required. The Director proposed to discontinue its application, but the applicant refused to consent to the application being discontinued. The applicant then sought to continue the Director’s application for judicial review. The Court of King’s Bench dismissed the applicant’s application and discontinued the Director’s application for judicial review. The applicant sought to appeal the discontinuance order, but the appeal was struck by the Registrar. The applicant’s application to restore the appeal was dismissed by a single judge of the Court of Appeal.
