Applicant Joseph O’Regan owned a unit in the respondent Carleton Condominium Corporation No. 169 (hereafter, “169”) condominium building. Mr. O’Regan brought an action against 169, alleging oppression, after 169 registered a lien on his condo unit in relation to some remediation work that it had completed.
169 brought a motion for summary judgment. The motion judge granted summary judgment and dismissed the action. The Court of Appeal dismissed Mr. O’Regan’s appeal.
