The applicant was successful on an appeal of an order striking out his claim in this action. The appeal court remitted the matter for redetermination in the lower court. The applicant sought the appointment of a case management judge to hear that, and other, applications in the action.

The Chief Justice of the trial court declined to appoint a case management judge and exercised his statutory authority to distribute the court’s work among its judges. He designated the same judge who originally heard the case to continue to hear it.

The applicant sought leave to appeal that order. A single judge of the Court of Appeal held that none of the applicant’s proposed grounds of appeal were of sufficient merit to warrant granting leave, and dismissed the application with costs.
