Ms. Lewans, the owner of three dogs, was charged with violations of the City of Swift Current’s Animal Control Bylaw, Bylaw No. 1-1991. She pled guilty to four of the charges. A Provincial Court Judge imposed a sentence that included an order that the dogs be destroyed. Ms. Lewans unsuccessfully appealed the sentence to the Court of King’s Bench. Her subsequent application for leave to appeal to the Court of Appeal was dismissed.
