The applicant, Tanya Rebello, filed two complaints with the Ontario Provincial Police. Dissatisfied with the results of the police investigations into her complaints, the applicant filed a lawsuit against the respondent, His Majesty the King in Right of Ontario as represented by the Ministry of Community Safety and Correctional Services (Ontario Provincial Police), alleging violations such as the breach of the police’s common law and statutory duties owed to her, as well as the breach of her rights under the Canadian Charter of Rights and Freedoms. In response, the respondent filed a motion for summary judgment to dismiss the applicant’s action. The Ontario Superior Court of Justice found that none of the issues raised by the applicant were genuine issues requiring a trial. It granted the respondent’s motion for summary judgment and dismissed the applicant’s action with costs. The applicant appealed the decision to the Court of Appeal for Ontario, however, the court dismissed her appeal with costs. It concluded that the motion judge made no error and exercised his discretion reasonably.
