The applicant sued the respondents for copyright infringement in Federal Court, concerning the respondents’ documentary about (and including footage from) the applicant’s narrative works.
The case management judge struck the applicant’s claim, without leave to amend, based on a finding of “cause of action estoppel”, in light of the applicant’s earlier copyright infringement action in the Ontario courts concerning the same works. A single judge at the Federal Court of Appeal dismissed the applicant’s appeal, and a three-member panel of the Court of Appeal dismissed a further appeal.
