Mr. Rouse and his co-accused were charged with possession of cocaine, possession of cocaine for the purpose of trafficking, and possession of proceeds of crime over $5,000, among other charges.

At trial, Mr. Rouse was acquitted on the drug counts, but convicted for possessing the proceeds of crime and resisting arrest. The Court of Appeal dismissed Mr. Rouse’s appeal of his conviction for possession of the proceeds of crime, noting the verdict of guilty for possession of proceeds of crime was not inconsistent with that of not guilty for possession of drugs.

The Court of Appeal granted Mr. Rouse leave to appeal his sentence, but dismissed the sentence appeal, holding that the trial judge expressly considered the collateral immigration consequences.
