Summary
Case summaries are prepared by the Office of the Registrar of the Supreme Court of Canada (Law Branch). Please note that summaries are not provided to the Judges of the Court. They are placed on the Court file and website for information purposes only.
The applicant, a salaried employee, instituted proceedings in the Superior Court against her employer, representatives of her employer, her union, officers of the union, and a minister of the Quebec government. The Superior Court ruled that it did not have jurisdiction to hear the dispute because the allegations were within the exclusive jurisdictions of a grievance arbitrator or the Administrative Labour Tribunal. The Superior Court granted motions to dismiss the proceedings. The Court of Appeal granted motions to dismiss the appeal.
Lower court rulings
Respondents’ motions to dismiss proceedings granted; applicant’s originating application dismissed
Motions to dismiss appeal granted; appeal dismissed
