The applicant requested records from a health information custodian. The health information custodian stated that no records responsive to the request existed. The Ontario Information and Privacy Commissioner declined not to consider the applicant’s complaint.

The Divisional Court concluded that it had no jurisdiction to grant leave to appeal a decision of the Information and Privacy Commissioner not to consider a complaint and it dismissed the applicant’s proceedings. The Court of Appeal dismissed the applicant’s appeal.
